PRIVACY POLICY

This privacy policy describes Muscleware's policy regarding the collection, use, storage and sharing and protection of your personal information ("Privacy Policy"). This Privacy Policy applies to the muscleware.com website (the "Site") and all related websites, applications, services and tools where reference is made to this Privacy Policy, regardless of how you access the Site. By using the Site, you give explicit consent to Muscleware for the collection, use, disclosure and retention of your personal information by us, as described in this Privacy Policy and our User Agreement. Muscleware may change or add to this Privacy Policy, so Muscleware encourages you to review it periodically.

When this policy refers to "Muscleware", it refers to Muscleware Inc., a body corporate duly registered under the laws of the province of Ontario, Canada, which is the company responsible for your information under this Privacy Policy.

If you see an undefined term in this Privacy Policy, it has the same definition as in our Terms of Use.

Muscleware is located in Canada. Information collected on the Site and through any associated applications may be stored in Canada. Therefore, your information may be subject to Canadian law. By using the Site, you consent to the transfer of your data overseas and across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. The laws governing data in your home country may differ from those in the countries to which data is transferred. By accessing and using the Site and any associated applications, you consent to the transfer of your data in this manner.


1. PERSONAL INFORMATION

By using the Site, you agree to the collection, transfer, storage and use of your personal information by Muscleware on servers located in Canada or any other country in which Muscleware's data maybe stored or hosted.



2. THE INFORMATION COLLECTED BY MUSCLEWARE

Muscleware may collect:

a. order or Registration Information. When you register for an event through the Site, Muscleware may request that you provide additional information such as your billing and shipping addresses and phone number; and

b. communications with Muscleware. Through your interactions with the Site and its services, Muscleware may collect information pertaining to statistics on page views, traffic to and from the Site or muscleware.com, referring URLs, IP addresses and standard web log information.



3. THE INFORMATION YOU PROVIDE TO MUSCLEWARE

Muscleware collects and stores any information you enter on the Site or that you provide to Muscleware when you use the Site. This information includes (but is not limited to):

a. information you provide to use when you register with Muscleware;

b. additional information that you may provide to Muscleware through your use of the Site (such as posing routine music uploading, international athlete invitation letters, the generation of official competitor certificates, and other such necessary functions to provide legitimate services to athletes); and

c. information provided in the context of dispute resolution, correspondence through the Site or correspondence that is sent to Muscleware.



4. HOW MUSCLEWARE USES YOUR PERSONAL INFORMATION

Muscleware and its third-party agents use, store and process information, including personal information about you, to provide, understand, improve, and develop Muscleware's services, create and maintain a secure environment and to comply with various legal obligations. Muscleware may use your personal information for the following purposes:

a. to provide you access to the Site by means of e-mail or telephone;

b. to prevent, detect and investigate potentially prohibited or illegal activities, fraud and security breaches and to enforce the User Agreement;

c. to personalize, measure and improve the Site and the Muscleware Service; and

d. to provide you with other services that you have requested as described when Muscleware collected the personal information.



5. DISCLOSURE OF YOUR PERSONAL INFORMATION TO THIRD PARTIES

Muscleware works with various third-party partners who help provide and improve Muscleware's products and services.

Muscleware may disclose your personal information to third parties in accordance with this Privacy Policy and applicable legislation and regulations. Muscleware will not disclose your personal information to third parties without your explicit consent.

Muscleware may share your personal information with:

a. service providers with whom Muscleware has entered into an agreement to provide the Muscleware Service and the Site (such as event promoters and official competition judges/statisticians);

b. certain third parties (including, but not limited to) law enforcement officials, if:

i. it is required by law; or

ii. if it is necessary for the prevention, detection or prosecution of criminal offences, such as fraud, deceit or prosecution; or

iii. to comply with legal obligations of a court order; or

iv. if it is necessary to maintain Muscleware's policies or to protect the rights and freedoms of others;

c. companies with which Muscleware intends to merge with in the context of re-organisation or that acquire Muscleware; or

d. intellectual property owners if the person claiming ownership or rights in intellectual property in good faith believes that information provided to Muscleware violates the rights of its owner.

 

The event promoter may use your personal contact information to provide updates and/or promotional information pertaining to the event and other related notices.



6. AGGREGATED DATA AND ANALYTICS

Muscleware may share aggregated information (i.e., information about users, competitors, registrants that Muscleware combines so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes. Muscleware also provides aggregated statistics and insights that help its vendors, partners and promoters understand how people are engaging with the Muscleware Service and the Site.

Muscleware may also provide advertisers and product vendors with reports about the kinds of people seeing their advertisements and how their advertisements are performing on the Site or through the Muscleware Service; however, Muscleware does not share information that personally identifies you (e.g., information such as your name or e-mail address that by itself can be used to contact you or identifies who you are) unless you provide Muscleware with your explicit permission.



7. DATA TRANSFER AND STORAGE

Muscleware is a global company and as such may transfer, store and process your information within Muscleware's affiliated companies, agents, or with service providers based in various countries and continents, including (but not limited to) South America, North America, Europe and Asia. Any such data transfers are necessary to provide the services set forth in the Terms of Use.



8. SECURITY

Muscleware works diligently to implement and update technical and physical security measures to protect your personal information against unauthorised access, loss, destruction or alteration. Some of these measures include data encryption and firewalls. In the event of any actual or suspected unauthorised use of your information provided to Muscleware, the Site or any affiliated services, please contact Muscleware following the instructions in the "Contact Us" section below.



9. SAFETY OF MINORS

Use of Muscleware, the Site and any affiliated services is not intended and may not be used by individuals under the age of 16 located in Canada or the age of 13 in the United States (or under a lower age if permitted by the laws of their residence). Muscleware does not knowingly collect personal data from minors or allow them to register for athletic shows or competitions. If it comes to Muscleware's attention that it has collected personal data from a minor, Muscleware may delete this information without notice. 10. YOUR RIGHTS

Muscleware acknowledges your right to access your personal data. Whenever you use Muscleware's services, Muscleware aims to provide you with access to your personal information. If that information is wrong, Muscleware strives to give you ways to update it quickly or delete it - unless Muscleware retains this information for legitimate business or legal purposes. When updating your personal information, Muscleware may ask you to verify your identity before acting on your request.

Muscleware may reject requests that are unreasonably repetitive, require disproportionate technical effort (e.g., developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems).

Where Muscleware can provide information access and correction, it will do so for free, except where it would require a disproportionate effort. If your data is incorrect, incomplete, or irrelevant you can ask to have the information corrected or removed.
